Despite the online halt, the Series 9 watch is still purchasable through other online retailers like Amazon, with some regions offering pre-Christmas delivery. Additionally, both models will remain available at physical Apple Store locations until Christmas Eve. For those who have already placed online orders for in-store pickup, collections can be made through December 24, as confirmed by Apple to TechCrunch.
This pause in sales stems from a patent infringement case involving health tech company Masimo. Apple has been embroiled in this legal battle for the past few years, with recent developments escalating to the suspension of these products. In a statement, Apple expressed its intention to continue challenging the rulings and its commitment to ensuring the availability of its products.
The dispute centers on a blood oxygen monitoring feature integral to the Apple Watch. Masimo alleges that Apple’s use of certain optical image sensors, introduced with the Series 6 in 2020, infringes on its patents. Additionally, Masimo accuses Apple of hiring away key personnel, including its Chief Medical Officer.
This halt in sales, particularly during the holiday season, poses a significant challenge for Apple. The company managed to keep the products available until just before Christmas, but some customers may face delays or substitutions for their holiday purchases.
